Terms of service for using the AWA Coaching platform

Important Notice
By creating an account or using the AWA Coaching platform, you agree to be bound by these Terms & Conditions. If you are registering on behalf of a child under 18, you confirm that you have parental responsibility and consent to these terms. Please read them carefully.
1. About These Terms
These Terms & Conditions ("Terms") govern your use of the AWA Coaching platform and services. These Terms constitute a legally binding agreement between you and:

3. Account Registration
3.1 Eligibility
- • Parents/guardians must be 18 years or older to create an account
- • Athletes under 18 must have an account created by a parent/guardian with parental responsibility
- • Athletes 18+ may create their own accounts
- • You must provide accurate, complete, and current information
3.2 Account Security
You are responsible for:
- • Maintaining the confidentiality of your password and account credentials
- • All activities that occur under your account
- • Notifying us immediately of any unauthorized use or security breach
- • Enabling multi-factor authentication (MFA) when available
- • Using a strong, unique password not used elsewhere
3.3 Account Restrictions
We reserve the right to suspend or terminate accounts that violate these Terms, our Acceptable Use Policy, or pose a safeguarding risk. You may not create multiple accounts or use another person's account without permission.
4. Our Services
AWA Coaching provides youth athletics coaching services including:
Coaching Sessions
Regular training sessions for various age groups and disciplines
Performance Tracking
Personal bests, training logs, and progress monitoring
Competition Management
Entry management, results recording, and roster building
Messaging Platform
Secure communication between coaches, athletes, and parents
Booking System
Session bookings, waitlist management, and attendance tracking
E-Commerce Shop
Athletics equipment, apparel, and team merchandise
Service Availability: We aim to provide uninterrupted access to the Platform, but cannot guarantee it will be available at all times. Services may be temporarily suspended for maintenance, updates, or due to circumstances beyond our control (weather, venue closures, etc.).
5. Payment Terms
5.1 Subscription Plans
- • Subscriptions are billed monthly in advance via Stripe
- • Prices are displayed on the Platform and may be updated with 30 days' notice
- • Subscriptions auto-renew each month unless canceled
- • You are responsible for maintaining valid payment information
- • Failed payments may result in account restrictions
5.2 One-Off Session Payments
Non-subscribers may book individual sessions at the displayed rate. Payment is required at the time of booking. Sessions must be used within the specified validity period.
5.3 Shop Purchases
All shop orders are subject to availability. Prices include VAT where applicable. Shipping costs are calculated at checkout. Payment is processed securely via Stripe.
5.4 Credits & Refunds
Account credits may be issued for canceled sessions or refunds. Credits expire as stated at the time of issuance. For full refund terms, see our Refund & Cancellation Policy.
Payment Processing: All payments are processed by Stripe, our secure payment provider. We do not store complete payment card details. By making a payment, you agree to Stripe's terms at stripe.com/legal.
6. Parental Consent & Safeguarding
For athletes under 18, parents/guardians must provide and maintain current consent for:

Safeguarding Commitment
All users must comply with our Safeguarding Policy. Parents, athletes, and coaches must acknowledge their respective Codes of Conduct annually. Violations may result in immediate account termination and reporting to relevant authorities.

8. Intellectual Property Rights
8.1 Our Content
All content on the Platform, including but not limited to text, graphics, logos, images, software, and compilation thereof, is the property of AWA Coaching or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
8.2 Your Content
You retain ownership of content you upload (messages, photos, training logs, etc.). However, by uploading content to the Platform, you grant AWA Coaching a non-exclusive, royalty-free license to:
- • Store and display your content on the Platform
- • Process your content to provide Services
- • Use anonymized performance data for coaching and analytics
- • Use photos/videos for marketing (only with explicit photography consent)
8.3 Photography Rights
AWA Coaching owns the copyright to photos and videos taken at our sessions and events. With your explicit consent (opt-in), we may use these for promotional purposes including website, social media, and printed materials. You may withdraw consent at any time by updating your settings or contacting us.
9. Limitation of Liability
9.1 Service Disclaimer
Athletics training involves physical activity that carries inherent risks. While we take all reasonable precautions, we cannot eliminate all risk of injury. Participants engage in activities at their own risk. We maintain appropriate insurance, but you are responsible for ensuring you have adequate personal insurance coverage.
9.2 Platform Availability
We provide the Platform "as is" and make no warranties regarding:
- • Uninterrupted or error-free operation
- • Accuracy, completeness, or currency of information
- • Compatibility with all devices or browsers
- • Freedom from viruses or harmful components
9.3 Limitation of Damages
To the fullest extent permitted by law, AWA Coaching shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- • Your use or inability to use the Platform
- • Unauthorized access to your account or data
- • Third-party conduct or content on the Platform
- • Service interruptions or errors
Important: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law.
10. Account Termination
10.1 Termination by You
You may terminate your account at any time by contacting us at admin@awasportscoaching.com. You remain responsible for any charges incurred prior to termination. Subscription cancellations follow the terms in our Refund & Cancellation Policy.
10.2 Termination by Us
We may suspend or terminate your account immediately, without notice, if you:
- • Breach these Terms or any of our policies
- • Engage in conduct that poses a safeguarding risk
- • Provide false or misleading information
- • Fail to pay required fees after reasonable notice
- • Use the Platform in a manner that could damage our reputation
10.3 Effects of Termination
Upon termination, your right to use the Platform ceases immediately. We will retain your data in accordance with our Privacy Policy and legal retention requirements (particularly safeguarding and financial records). You may request data deletion subject to these requirements.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes:

Your continued use constitutes acceptance of new terms
If you do not agree to the updated Terms, you must discontinue use of the Platform and terminate your account before the changes take effect.
12. Dispute Resolution
12.1 Informal Resolution
If you have a dispute or complaint, please contact us first at complaints@awasportscoaching.com. We will make every effort to resolve the matter informally. See our Complaints Procedure for details.
12.2 Alternative Dispute Resolution
For consumer disputes, you may be eligible for alternative dispute resolution (ADR) through an authorized ADR provider. We will participate in good faith if you choose this option.
12.3 Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have rights under consumer protection laws in your country of residence.
13. General Provisions
Entire Agreement
These Terms, together with our other policies, constitute the entire agreement between you and AWA Coaching.
Severability
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
